ECUGIE / LEGAL

Terms of Use

ECUGIE TECHNOLOGIES · Version 1.0 · Updated 23 October 2026

Welcome to the ECUGIE TECHNOLOGIES (“ECUGIE”, “we”, “our” or “us”) website. These Terms of Use govern access to publicly available pages, content, features and forms. If you do not agree, discontinue use. These website Terms do not replace separately executed customer, employment, confidentiality or other contracts.

1. Acceptance of Terms

By accessing or using the ECUGIE website, you agree to these Terms and applicable laws. Please also review our Privacy Policy. If you act on behalf of an organisation, you confirm that you are authorised to submit information or act for it. Additional terms may apply to particular features. These Terms do not remove rights that cannot legally be excluded.

2. Changes to Terms

ECUGIE may revise these Terms to reflect changes in the website, business operations or applicable law. Updated Terms will be posted with a revised date. We will provide further notice or obtain consent where legally required. Continued use after changes take effect constitutes acceptance to the extent permitted by law.

3. Permitted Website Use

You may browse information about ECUGIE, review technical and educational materials, make genuine business enquiries, explore opportunities and submit legitimate job applications. Provide accurate information when using forms and use the website responsibly.

4. Prohibited Activities

Do not attempt unauthorised access; interfere with availability or security; introduce malware; bypass authentication; conduct intrusive security testing; impersonate others; submit fraudulent enquiries or applications; unlawfully collect personal data; infringe intellectual property; or use automated systems to overload the website. Lawful search indexing, accessibility tools and ordinary browsing are not prohibited merely because they are automated.

5. Intellectual Property Rights

Unless otherwise stated, original site content, branding, logos, software, graphics and documentation belong to ECUGIE or its licensors and may be protected by intellectual property laws. You may access and view public content for personal, informational and internal business-evaluation purposes. No permission is granted to misrepresent, commercially exploit or redistribute protected materials except as permitted by law or an applicable licence. Do not use ECUGIE marks to suggest endorsement without written permission.

6. Open-Source and Third-Party Technologies

The website may refer to or use open-source components and third-party tools. Their respective licences and intellectual property rights continue to apply. Nothing in these Terms overrides open-source permissions or implies ownership or endorsement of independent products.

7. Website Content and Technical Information

Articles, insights, case studies, technical explanations and service descriptions are for general information, not project-specific advice or binding commitments. Technology and industry practices change. Illustrative examples and outcomes are not guarantees of equivalent results.

8. Business Enquiries and Service Requests

Submitting a contact or project enquiry does not create a customer relationship, binding agreement, guaranteed quotation, delivery commitment or obligation to respond. Any engagement requires mutually agreed terms covering scope, fees, deliverables, timelines, confidentiality and intellectual property. ECUGIE may lawfully decline enquiries.

9. Careers and Recruitment

Job applications should contain accurate information and materials you are authorised to submit. Applying does not guarantee an interview, offer or employment. Job descriptions and processes may change. Recruitment data is handled under the Privacy Policy and applicable law.

10. Information Submitted by Users

You retain ownership of original submissions, subject to third-party rights. You give ECUGIE a limited, non-exclusive permission to access, store, internally reproduce and process submissions as reasonably necessary to respond to enquiries, assess recruitment or potential engagements, operate relevant features and comply with law. This is not an unrestricted right to publish confidential materials or use applications for promotion. You confirm that you have rights to submit the material.

11. Confidential and Sensitive Information

Do not submit passwords, financial credentials, sensitive personal information, confidential databases, proprietary source code or trade secrets through general enquiry forms. A general enquiry does not by itself create a contractual nondisclosure obligation. Where necessary, parties may sign a separate NDA. Personal data remains subject to the Privacy Policy and applicable law.

12. Privacy and Personal Data

The Privacy Policy describes data collection, purposes, sharing, safeguards, retention and individual rights. Review the policy at /privacy-policy. ECUGIE will provide further notices or obtain consent where required by applicable law.

13. Cookies and Similar Technologies

The website may use cookies or similar technologies for necessary functionality and other disclosed purposes. Optional analytics or tracking depend on the actual implementation. Review /cookie-policy for further information. Consent choices will be provided where legally required.

14. Website Availability and Maintenance

The website may be unavailable due to maintenance, updates, technical failures, security events or circumstances outside reasonable control. ECUGIE may modify or discontinue features as reasonably necessary and aims to minimise avoidable disruption.

15. Website Security

Visitors must not circumvent security controls. Potential vulnerabilities should be reported through official contact channels; reporting does not authorise exploitation, intrusive testing, access to others’ data or disruption. ECUGIE may investigate misuse and take proportionate protective action.

16. Third-Party Websites and External Links

Links to external websites are provided for convenience or information. Unless expressly stated, ECUGIE does not control or endorse independent websites and is not responsible for their content, availability, security or privacy practices. Their own terms apply.

17. External Tools and Integrations

Website features may rely on independent hosting, communications, document-storage and other providers. Provider terms and limitations may apply. ECUGIE remains responsible for its own legal and contractual obligations but does not guarantee uninterrupted independent third-party services.

18. Disclaimer of Warranties

To the extent permitted by law, the website and general information are supplied “as is” and “as available” without a guarantee of uninterrupted access, accuracy or suitability for every purpose. This does not exclude mandatory legal warranties or obligations, or override separately agreed service commitments.

19. Limitation of Liability

To the maximum extent permitted by applicable law, ECUGIE is not liable for indirect, incidental, special or consequential losses arising from website use or unavailability. Nothing excludes liability for fraud, wilful misconduct or liabilities that cannot legally be excluded. Separate signed contracts govern their own liability provisions.

20. Indemnification

To the extent permitted by law, you agree to indemnify ECUGIE for reasonable third-party claims, losses and expenses arising directly from unlawful website use, infringement of others’ intellectual property, deliberate malicious or fraudulent submissions, or material breach of these Terms. This does not cover losses caused by ECUGIE’s own unlawful conduct.

21. Suspension and Restriction of Access

ECUGIE may proportionately restrict or suspend access to address security threats, unlawful conduct, serious violations or legal requirements, with notice where appropriate and practicable.

22. No Professional or Contractual Relationship

Using the website or reading its content does not independently create a consulting, advisory, fiduciary, employment, agency or partnership relationship. Binding engagements arise only through an applicable agreement or other legally recognised basis.

23. No Guarantee of Business Outcomes

Service descriptions and methodologies explain potential capabilities, not guaranteed financial, operational or technical results. Outcomes depend on project circumstances. Any performance commitment must be agreed separately.

24. Accessibility and Responsible Use

ECUGIE aims to make the website usable by a broad range of visitors and may improve accessibility over time. Please report difficulties through official contact channels. No certification against a particular accessibility standard is claimed unless established.

25. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Subject to mandatory legal provisions, disputes concerning these Terms or website use fall within the jurisdiction of competent courts in Gurugram, Haryana, India. Mandatory statutory rights and remedies remain unaffected.

26. Severability

If a provision is invalid or unenforceable, it will be limited or severed to the extent necessary and the remaining Terms will continue where lawful.

27. No Waiver

A failure or delay by ECUGIE to enforce a provision is not a waiver of that provision or another legal right. Any waiver must comply with applicable law.

28. Assignment

Visitors may not transfer rights or obligations in a way that imposes obligations on ECUGIE without consent. ECUGIE may transfer rights or obligations in a lawful restructuring or transfer of operations, subject to applicable law and contracts.

29. Entire Agreement

These Terms and applicable website notices govern general website use but do not supersede separately executed customer, employment, confidentiality or other specific agreements. A separate agreement prevails for the matters it expressly governs.
